Its primary use is for turning mobile phones into wireless controllers, where the mobile device uses its built-in controls to communicate to a web-based game. The phone connects directly to the game through the browser, bypassing the intermediary server, which results in a fast response rate. The first game to use this software development kit (SDK) is Star Wars: Trench Run 2.0, where players can use an iPod Touch or iPhone as a wireless game controller to play the game full screen on a computer.

People behind the company:
Jim Bull, CEO, has also founded the software services companies Strategic Marketing Partners Inc. and Strategic Merchandising Partners Inc. Before becoming Brass Monkey’s chief technology officer and president, Chris Allen founded web 2.0 development house Infrared5, where he continues to serve as CEO and president. Jonathan Leach is the senior vice president of sales and was previously in charge of sales at Sennari Mobile and Zeemote Inc.

The advisors:
On their advisory board are Roger Sanford, MediaTile Inc.’s executive vice president; Tom Dusenberry, president of Dusenberry Entertainment; and Anthony Simpson, former president of Verizon Wireless’ west coast division.

The pitch:
The company is raising $1 million in its seed round. Half of that amount will be used to finish additional mobile device SDKs, and the other half will be used for sales, public relations and marketing. The company is also seeking strategic relationships with a variety of technology companies. Brass Monkey currently has partnerships with gaming companies ranging in size from Alcatel-Lucent, through its California-based agency MediaTile Inc., to small, independent game studios.

Accomplishments:
The company is a third round finalist in MassChallenge’s startup competition. It is also a finalist in the Mass Technology Leadership Council’s Product of the Year 2010 competition. The company won the “coolest new technology” award at this year’s MIT Enterprise Forum In-NOW-vation awards.

The market:
The company is seeking to tap into the online gaming market, which Bull estimates is worth $2.3 billion worldwide. The company is currently monetizing its technology through licensing, revenue shares from downloads and in-game advertising and application development. It anticipates a future revenue stream from service contracts for existing contracts.

The competition:
Bull said the company does not have any direct competitors using their type of technology yet but said that likely competitors would be game controller hardware manufacturers. However, he said the company sees all of them as potential clients and not really competitors. That’s why everyone giving rapid response to online gaming

Although the LGA controls all activities related to gambling in Malta, and rakes in millions of euros every year from licensing and regulating the 392 online casino, poker and gambling sites governed by Maltese jurisdiction, the German gambler claimed that he has waited for more than two years for the LGA to take a decision about his winnings from Casino Club, which is a subsidiary of GVC holdings, a leading online gaming company.

When contacted, a spokesperson for the LGA told The Malta Business Weekly that “without going into the specific merits of the case in question, the authority has not yet concluded its investigations and neither has it decided in favour of the licensee as is being alleged”.

The report alleges that the LGA told the German player that Casino Club is not duty bound to pay his full winnings because of a law in the Maltese legislation which is unclear in forcing licence holders to pay gambling debts, rendering the LGA powerless to intervene in such issues because of this, and other laws, in Malta.

The German player claims that he had been gambling at Casino Club since 2003, up until his big win. Lawyers from Germany advised the player that he would have to contest the issue in the Maltese courts – a process which they told him is likely to take a lot of time and money. This action would compel the casino, the lawyers told him, to prove its allegations of “illegal” conduct by the player and show why the casino decided that the player was not welcome to gamble large amounts of cash.

In the meantime, a Casino Club spokesperson said they were justified in taking such action and that the LGA had been supplied with all the details about this particular, and the LGA later found the casino in favour of its actions.

However, rebutting these claims, the LGA spokesperson replied: “the LGA’s interpretation is that the Civil Code articles regarding online gambling are applicable to gaming debts arising out of unauthorised/unlicensed games, which in any case are considered as illegal and tantamount to a criminal offence.

“Furthermore, remote gaming regulations do not stipulate any limits with respect to player winnings, and if the licensee chooses to cap or place limits on the maximum prices that can be won by players, as already reiterated, these conditions would have to be stated in the rules of the game and in the terms and conditions.

“Casinos jackpots and rules relating to jackpots vary from one licensee to another and the rules of the jackpots as well as any applicable limits would be explained in the relative terms and conditions of the particular licensee’s website.”
